Terms of Service

Make Contact helps people preserve the context behind real-world connections. These Terms explain the rules that keep that experience useful, respectful and safe.
1. Accepting these Terms
These Terms of Service (“Terms”) govern your access to and use of Make Contact, including our app, website, Memory Cards and related services (collectively, the “Service”).
By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
2. Who may use Make Contact
You must be legally able to agree to these Terms in your location. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms on your behalf.
3. Your account
You are responsible for the accuracy of the information you provide, for safeguarding your account credentials and for activity that occurs through your account.
Please notify us promptly if you believe your account has been accessed without permission.
4. Memory Cards and your content
You retain ownership of the photos, notes, contact details and other material you create or upload (“Your Content”).
You give Make Contact a limited, non-exclusive license to host, process, reproduce and display Your Content only as necessary to operate, maintain and improve the Service and to let you create, store and share Memory Cards. This license ends when Your Content is deleted from our systems, except where limited retention is required for security, legal compliance or backup processes.
You are responsible for Your Content and for having the rights and permissions needed to upload and share it, including permission from people shown in photos or identified in a Memory Card where required.
5. Respectful use
You may not use the Service to:
- harass, threaten, stalk, impersonate or exploit another person;
- share private, intimate or sensitive information without permission;
- upload content that is unlawful, harmful, deceptive or infringes another person’s rights;
- send spam or unwanted promotional messages;
- interfere with the Service, bypass its safeguards or attempt unauthorized access; or
- use automated methods to scrape, copy or abuse the Service.
We may remove content or restrict access when we reasonably believe these Terms have been violated or action is needed to protect people, Make Contact or the integrity of the Service.
6. Sharing and other people
Memory Cards are designed to be shared. Before sharing, check that the card contains only information you intend the recipient to receive. Recipients may save, copy or reshare information after receiving it. Make Contact cannot control what another person does with content once it has been shared with them.
7. Privacy
Our collection and use of personal information is governed by our Privacy Policy. Where the Service lets you add information about another person, please use care, respect their privacy and share only what is appropriate and permitted.
8. Our Service and intellectual property
Make Contact and its licensors own the Service, including its software, design, name and other materials, excluding Your Content. These Terms give you a personal, limited, non-exclusive, non-transferable and revocable right to use the Service as intended. They do not transfer ownership of the Service to you.
9. Changes and availability
We may update, add, suspend or discontinue parts of the Service. We aim to keep Make Contact available and reliable, but we do not promise that it will always be available, uninterrupted, secure or error-free.
10. Ending your use
You may stop using the Service at any time. We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk for other people or the Service, or where required by law. Provisions that by their nature should survive termination will remain in effect.
11. Disclaimers
The Service is provided on an “as is” and “as available” basis to the extent permitted by law. Make Contact does not guarantee that using the Service will lead to a reply, continued relationship or any particular outcome. Nothing in these Terms limits consumer rights that cannot legally be waived.
12. Limitation of liability
To the fullest extent permitted by law, Make Contact will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, opportunity, goodwill or profits arising from your use of the Service. Where liability cannot be excluded, it will be limited to the maximum extent allowed by applicable law.
13. Changes to these Terms
We may update these Terms as the Service evolves. If a change is material, we will provide reasonable notice through the Service or another appropriate channel. Your continued use after the updated Terms take effect means you accept them.
